Biomet, Inc. has agreed to settle 24 bone stimulator lawsuits of patients who sued the medical device maker as part of their medical malpractice suits against osteopath John King, who practiced in West Virginia until 2003, according to Biomet’s filing with the U.S. Securities and Exchange Commission on Monday.

The lawsuits involved the Ionic Spine Spacer System and SpF and OsteoGen implants manufacured by Biomet’s EBI subsidiary, the SEC filing said. Biomet has set taken aside a $39 million after-tax charge to settle the suits.

Federal authorities are conducting their own investigation of allegations that Biomet has engaged in improper sales, promotion and billing of Biomet Inc. devices designed to promote bone growth following spinal surgery.
