Insurance Company Takes Heat for Filing Slip and Fall Lawsuit

It's nice to see the shoe on the other foot. Sentry Insurance is being criticized for being too litigious. Sentry has sued an 81-year-old Brookfield, Wisconsin woman over injuries suffered by a member of a meal-delivery team who slipped and fell on a patch of ice in her driveway three years ago. Apparently, Sentry paid medical benefits for the delivery person and is seeking to recover those from the homeowner. Sentry is now the butt of criticism for the suit in local papers and blogs.

Sentry feels justified in using the court system to seek recovery of losses it believes should in fairness be borne by another party-- in this case the homeowner's liability insurance carrier for the elderly homeowner. The courts are there to sort out claims of this kind. Hopefully, Sentry will be sensitive the next time I file a slip and fall lawsuit against one of its customers.
