The recall of contaminated pet food manufactured by Menu Foods, Inc. of Streetsville, Ontario, Canada, will awaken the public to the fact that state laws give rather meager court remedies to owners who lose a pet due to negligence. The recall, announced March 17, 2007, involved 60 million containers of pet food of the "Cuts and Gravy" style. The food was sold in stores between December 3 and...

A $4.1 million judgment awarded against a Tennessee nursing home is generating debate in that state over the rights of abused residents to compensation versus the costs to insurance companies and nursing home operators. The jury heard evidence that the resident developed bedsores, and had an undiagnosed hip fracture and other problems, all of which were ignored by the nursing home because of...

Peanut butter contaminated with Salmonella has sickened at least six Wisconsin consumers according to the Wisconsin Department of Health and Family Services. The six reported cases took place between September 5, 2006 and January 28, 2007, and sickened consumers in several Wisconsin counties, including Dane, Manitowoc, Milwaukee, Outagamie, Washington and Winnebago. ConAgra Food's peanut butter...

A report published by CNN after an 18 month investigation about minor impact soft tissue injury cases reveals that victims in these auto accident cases are likely to be shortchanged when it comes to compensation. These accident victims, though they are not at fault, have little leverage when dealing with insurance adjusters because accident attorneys are often reluctant to accept cases...

An editorial from the Appleton Post-Crescent responds to the frightening views about judicial independence purveyed in a recent speech by U.S. Attorney General Alberto Gonzalez. The Bush Adminstration sees our constitutional scheme as one that would have the judiciary defer to the judgments of the executive and legislative branches. Rightfully calling these views "appalling", the editorial...

Today's New York Times editorial page features an excellent piece that illustrates the unfairness of "tort reform", whose purpose is to protect business by denying compensation to personal injury victims. The article focuses on an egregious situation in the State of Alabama where a chemical injury victim is barred from suing until "manifest injury" has surfaced, but then has the case dismissed...

An apparent propane gas explosion at a Milwaukee factory has claimed the lives of at least three workers and injured at least 37 others. Rescue workers are sifting through the remnants of the building in which the explosion occurred, part of the Falk Corporation manufacturing headquarters in the Menominee Valley adjacent to downtown Milwaukee. According to a report on the Milwaukee Journal...

A nationwide surveillance study to be published today in the Journal of the American Medical Association reports that over 700,000 people annually report to hospital emergency rooms as the result of adverse reactions to medicines, including cases of overdoses and allergic reactions. A New York Times story about the bad drug reactions that took people to the emergency rooms points out that the...

The U.S. Chamber of Commerce, attack dog for big business, has launched a multi-million dollar ad campaign that purports to identify states that supposedly favor accident victims over corporations. The Chamber's campaign has been purveyed in full page ads in national circulation newspapers, on the internet, and in local papers in key states. The Chamber's efforts, and the response of the...

A state-by-state report issued by the AFL-CIO, issued in conjunction with the upcoming Worker's Memorial Day this Friday, presents a mixed picture on the status of workplace safety in America. Analyzing data from 2004, the report shows that rates for deaths in the workplace increased for the first time in a decade, while rates for illnesses and injuries experienced a slight decline. The...

According to a report in The NY Post, Johnson & Johnson subsidiary Ortho McNeil has begun settling Ortho Evra Birth Control Patch claims and estimates that there are approximately 500 serious injury victims, compared to less than 100 such victims with oral contraceptives. The report states that "Ortho McNeil has settled a dozen lawsuits for millions of dollars in the last few months."

They are at it again: The Republican legislators and their insurance industry puppeteers have passed a bill designed to impede victims of medical malpractice from seeking compensation for their injuries. The bill would limit the attorneys fees that can be charged to victims of medical malpractice, leaving untouched (of course) the amount that doctors and hospitals can pay to their attorneys to...

Vice President Cheney's hunting accident case parallels 1999 shotgun accident involving basketball coach Bobby Knight. Both cases involved the violation of basic rules of hunting safety.Vice President Richard Cheney's hunting accident on a private ranch in Corpus Christi, Texas, once again places needed attention on the topic of hunting safety. Hunting experts seem to agree that Cheney violated...

While I am managing cases involving slips and falls on ice in Wisconsin, across the globe in Turin, Italy a classmate of mine is handling a much more high profile case. When U.S. Olympic figure skater and gold medal hopeful Michelle Kwan fell during practice in Turin, Italy, raising concerns that ultimately led to her withdrawal from the 2006 Winter games due to injury, she was seen being...
